Without seeing his contract it's almost impossible to suggest what he may have done. It would - if it were post 2 years - be open to agreement of misconduct, gross misconduct, etc. It's unlikely that his agents speaking with a future employer would be more than misconduct so the gardening leave - limiting his options and forcing him to resign - would likely be seen as excessive.
Since he's not over 2 years employed, it's moot though. His contract is likely to include separation clauses though - they'll be interesting to read, common in football, and something - if we're to believe the relationship has been poor for a while - will have been inserted by his team.
It'd be an open and shut constructive dismissal employment tribunal case. Irrespective of what he did and didn't do, the club moving him aside and bringing someone in would trigger compensation and he'd win.
We lost a contract with a company about 15 months ago. 3 months before that we knew they had problems so we started scouting around to see what work was around and available. Not disloyal but protecting ourselves.
This is the same for Marti; his agents are looking around and preparing 'just in case' it becomes necessary. I would hope Nourry realises what he has, but am worried we're about to go through the rinser again.
